... Five years Of My Life
.......No company should submit retaliation, harassment, intimidation against an employee just because the employee has filed a legitimate claim, and less if the worker is injured while doing their job. As a Christian chaplain, I know that my faith and the power of God and his mercy has made it possible for me to share with you the gifts that I have been given five years ago. In August 22, 2008 I had an accident at work, suffered multiple physical injury, injuring my back, elbow and right knee, two fingers of my left hand, but the physical injury was nothing compared to the psychological damage it had caused me.
I went from being an outstanding worker in the department of quality control and also making collaboration and contribution of my formats and other tools to design after hours at home for the company, and therefore I was receiving congratulations and appreciation for my work even the managers would tell me I was expecting a great future in the company, I never imagined that after my accident everything would change, from day to night.
They began by not giving me the medical care to all my injuries, to try to coerce a change to lend attention to my injuries, they also tried intimidating me into signing some documents, which neither I fully understood and was also refused a copy of the document because I had not signed it. They called security; they took my card work, the vest, which I got to use during working hours, and was escorted, off the premises of the company not knowing if I was fired at that time.
Then I knew it was a suspension without payment. Within a couple days I got a call from the HR manager asking me if I wanted to keep my job, In order to answer her I had to take in account that my daughter. She had entered a Private University in Cusco Peru in that year, my parents of age were under my responsibility, I had a daughter that was thirteen years old, I had to pay a mortgage, car, isurance, dougther's university etc.. Just thinking about my family I didn’t know what would happen if I was to have lost my income when injured. HR manager told me that I would return to present work, was when the supervisor started talking with strong contempt because I had caused trouble with his boss for not having accepted and signed the papers, since then my work environment became a nightmare.
I was harassed by the supervisor at all times, my supervisor began to exercise retaliation against me every day until I had to report to the Human Resources department, for his retaliation, harassment, abuse and non-compliance with my medical restrictions, but my situation worsened when reporting to my supervisor with the HR department, the supervisor intensified retaliation against me. situation led me to report it a second time. the supervisor exercised its retaliation and harassment against me as if authorized to do so. The sending end to forced labor that did not comply with my medical restrictions and telling me that if I did not I could be fired. He has sent me to clean and sweep the dust off the shelves, (rackets), which had an inch of black dust despite my condition with a back injury, elbow, knee and two fingers of my hand, I I told the supervisor that dust would make me harm, but he ignored me, and without proper protective equipment I had to do that job for fear of losing my job. the supervisor was going through my area with another supervisor laughing, mocking, I bathed in dust, and my eyes and throat irritated. At the end of my task he laughed at me and I told him he was an abuser and I would report back to the HR department , but in fact that did nothing, and having witnesses they never investigated. The HR manager allowed that the next day I’d be placed to clean dust again, I finished the job with swollen eyes and sore throat. At the end of my work he laughed at me and I told him you are was an abuser and I denounces it back to the human resources department, but they did nothing. which eventually I ended up with a powder poisoning from inhaling or swallowing the dust. I also got an infection to the eyes and throat. All of that is documented by their physicians, for filing a complaint of a injured worker, the supervisor not only was abusive but others treated me the same as the managers, starting with HR to general manager of the facility many things happened and nothing was done about the situation therefore I felt discriminated. I worked with pain and my recovery was slow, continued working, they refused me to go to my doctor's appointment. The work assigned to me by my supervisor did not comply with medical restrictions. and they did not allow me to see a specialist. I tolerated their abuses because I needed to keep my job, but it was useless, because the 12th of November of the same year 2008, They took me to the HR office and I was wrongfully terminated without a valid reason. They insisted that I would sign some papers, and I refused to sign; they wanted me to give up my right to claim, and to take charge of my accident. After maintaining a discussion with them, they took my ID card, my vest, and I was forced to leave the premises of the company and unjustly fired from the company. When I was being escorted by the manager of operation, In the parking lot of the company I suffered a panic attack. I could not breathe and my legs were shaking so the security called 911. The ambulance came and took me to the emergency Palmetto General Hospital.
Thank God it was not a heart attack but instead a nervous breakdown or panic attack. My colleagues also would tell me that every worker who is injured, they (the company) always finds a way to get rid of the injured worker and now I can say that is entirely true, because it happened to me. I share with you that have wanted to keep reading these lines and know more about what happened and what I experienced in that company. You have just begun to read a part of this true story that I will one day write into a thousand pages. if God is willing, everyone should know the truth and this shall be documented. because you can not accept these abuses in the 21st century in one of the world's most developed countries where it is said to promote and respect human rights. How many coworkers have not dared to face these companies for their economic power and have been unjustly laid off from work having been injured. But God, my lawyers and I fought in court against its injustices, taking them all to the bench in front of a judge and jury. I took them to court, and the process took four long years which I will also write if God permits. I always say: "If God is for us, who is against us"
Now 2013 I continue with my treatment, but I am still in need of two surgeries. The pain continues, I'm in neurological treatment, and I try to switch psychiatrist prescription drugs and psychological treatment for meditation and the word of God. I even need orthopedic treatment. I hope to recover and not have emotional relapses because these interruptions have stopped me from completing my Masters degree at the University.
Although I have lost many materialistic things, house, land, car, savings, jewelry, etc., I thank God every day for the simple miracle of being alive and God is my light and my hope. I know God has a purpose for me as it has for each of you.
